Is a SWPPP required in Arizona?
Yes. Under the Arizona Pollutant Discharge Elimination System (AZPDES) Construction General Permit, most construction projects in Arizona must have a Stormwater Pollution Prevention Plan (SWPPP) if:
- The project will disturb one acre or more of land, or
- The project will disturb less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
If either applies, you are required to prepare and implement a SWPPP. Failure to comply can result in serious consequences, including:
- Civil penalties:
- Up to $10,000 per day for certain violations under Arizona law
- Up to $25,000 per day per violation for willful or egregious violations under Title 49 of the Arizona Revised Statutes
- Stop-work orders that bring your project to a halt

- In extreme cases, even criminal penalties, including up to a year in jail

Who regulates SWPPP in Arizona?
The Arizona Department of Environmental Quality (ADEQ), Division of Water Quality, administers the state’s AZPDES program. ADEQ issues permits, monitors compliance, and enforces Arizona’s stormwater regulations, so having a compliant SWPPP is essential.
How long does a SWPPP last?
A SWPPP is required only during the active construction phase. When your project is complete, coverage under the AZPDES Construction General Permit ends through a Notice of Termination (NOT) submitted to ADEQ.
