Is a SWPPP required in Colorado?
Yes. Under Colorado’s Construction Stormwater Permit (COR400000) — part of the Colorado Discharge Permit System (CDPS), managed by the Colorado Department of Public Health & Environment (CDPHE) — many construction sites must have a SWPPP if:
- The project disturbs one acre or more, or
- It disturbs less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
If either of those conditions apply, you are legally obligated to develop and implement a SWPPP to comply with CDPHE’s permit.
Failing to maintain a SWPPP or violating permit conditions can lead to serious enforcement actions, including:
- Civil penalties: Under Colorado law, permit violations can incur up to $65,544 per day per violation as of January 2025.
- Stop-work orders: CDPHE or local authorities may issue stop-work orders if violations are discovered.
- Corrective actions: You may be required to fix issues, like improving erosion controls or stabilizing disturbed areas.
- Criminal penalties: For willful or severe violations, the Colorado Water Quality Control Act allows criminal enforcement.

Who regulates SWPPP in Colorado?
The Colorado Department of Public Health and Environment (CDPHE), Water Quality Control Division, oversees the state’s stormwater program. CDPHE issues permits, monitors compliance, and enforces regulations, making a compliant SWPPP essential for your project.
How long will the SWPPP last?
A SWPPP is required only during active construction. Once your project is complete, coverage under the Construction Stormwater Permit ends after submitting a Notice of Termination (NOT) to CDPHE.
Do I need to update the SWPPP if the project changes?
