Is a SWPPP required in Florida?

Most construction projects in Florida must have a Stormwater Pollution Prevention Plan (SWPPP) if any of the following apply:

  • The project will disturb one acre or more of land.
  • The project will disturb less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
  • The Florida Department of Environmental Protection (FDEP) determines that a project disturbing less than one acre could affect nearby waterways or their tributaries.

If any of these conditions are met, a SWPPP must be prepared before applying for coverage under Florida’s Construction General Permit. Having a compliant plan in place protects water quality, helps avoid fines, and keeps your project on schedule.

Florida SWPPP FAQs

What are the SWPPP requirements in Florida?

A SWPPP is required when the land for the construction site:

  • Disturbs 1 acre or more, or
  • Is part of a larger common plan of development that totals 1 acre or more, AND
  • Discharges stormwater into surface waters or a municipal separate storm sewer system (MS4)
Who regulates SWPPP in Florida?

The Florida Department of Environmental Protection (FDEP) enforces the Construction General Permit (CGP) and oversees SWPPPs in the state. FDEP reviews permits, monitors compliance, and enforces stormwater regulations, with local agencies sometimes assisting in inspections and enforcement.

How long will the SWPPP last?

A SWPPP is a temporary document that is only required during construction. In Florida, coverage under the Construction General Permit ends once stormwater controls are in place and the site is stabilized. The SWPPP is then closed with a Notice of Termination (N.O.T.) filed with the FDEP.

Do I need to update the SWPPP if the project changes?
