Is a SWPPP required in Georgia?
Yes. Under the Georgia Erosion and Sedimentation Control Act most construction projects in Georgia must have a Stormwater Pollution Prevention Plan (SWPPP) if:
- The project will disturb one acre or more of land, or
- The project will disturb less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
If either condition applies, you are required to prepare and implement a SWPPP to comply with state regulations.
Failing to do so can result in serious consequences, including:
- Civil penalties: Violations can lead to civil penalties up to $2,500 per day per violation. Repeat or willful violations may result in higher penalties.
- Stop-work orders: The Georgia Environmental Protection Division (EPD) has the authority to issue stop-work orders to halt construction activities until compliance is achieved.
- Criminal penalties: In cases of knowing violations that place another person in imminent danger of death or serious bodily injury, penalties can include fines up to $250,000 and imprisonment for up to 15 years, with the possibility of a second conviction leading to fines up to $500,000 and imprisonment for up to 30 years.
