Is a SWPPP required in Idaho?
Yes. Under the Idaho Pollutant Discharge Elimination System (IPDES) Construction General Permit, most construction projects must have a Stormwater Pollution Prevention Plan (SWPPP) if:
- The project will disturb one acre or more of land, or
- It will disturb less than one acre but is part of a larger common plan of development that will ultimately disturb one acre or more.
If either applies, you are legally required to develop and follow a SWPPP to stay compliant with Idaho Department of Environmental Quality (DEQ) regulations.
Failing to do so can lead to serious consequences, including:
- Civil penalties up to $10,000 per violation or $5,000 per day for each day of a continuing violation under Idaho Code § 39-175E and § 39-108. (The federal Clean Water Act may impose even higher penalties if the EPA enforces the violations directly.)
- Stop-work orders issued by Idaho DEQ or local authorities
- Mandatory corrective actions
