Yes, most construction projects in Nevada require a Stormwater Pollution Prevention Plan (SWPPP) if:
- The project will disturb one acre or more of land.
- The project will disturb less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
- The Nevada Division of Environmental Protection (NDEP) determines that a project disturbing less than one acre will impact receiving waters or their tributaries within a 1/4-mile radius of the project.
If any of these conditions apply, a SWPPP must be developed before applying for coverage under the Construction Stormwater General Permit.

What are the SWPPP requirements in Nevada?
If your Nevada construction project disturbs 1 acre or more, you’re required to get a construction stormwater permit and prepare a SWPPP.
For industrial projects, if you’re in an industry covered under 40 CFR §122.26(b)(14), you must obtain a Multi-Sector General Permit (MSGP) and develop a SWPPP.
Who regulates SWPPP in Nevada?
The Nevada Division of Environmental Protection (NDEP) is the state agency responsible for implementing Nevada’s Construction Stormwater General Permit program. NDEP oversees the issuance of SWPPP permits, ensures compliance, and enforces stormwater regulations across the state.
How long will the SWPPP last?
A SWPPP is only temporary. The plan is applicable during the active construction phase of the project. Once your project is complete, the SWPPP is concluded via a Notice of Termination (N.O.T.).
Do I need to update the SWPPP if the project changes?
