Is a SWPPP required in North Carolina?
Yes. In North Carolina, most construction projects must have a SWPPP under the state’s NCDEQ stormwater program and the applicable Construction General Permit.
A SWPPP is generally required if:
- Your project will disturb one acre or more of land, or
- It will disturb less than one acre but is part of a larger common plan of development that will ultimately disturb one acre or more
If either condition applies, you are legally required to prepare and implement a SWPPP to stay compliant with NCDEQ stormwater regulations.
Failing to have a compliant stormwater pollution plan in North Carolina can lead to significant consequences, including:
