Is a SWPPP required in North Carolina?

Yes. In North Carolina, most construction projects must have a SWPPP under the state’s NCDEQ stormwater program and the applicable Construction General Permit.

A SWPPP is generally required if:

  • Your project will disturb one acre or more of land, or

  • It will disturb less than one acre but is part of a larger common plan of development that will ultimately disturb one acre or more

If either condition applies, you are legally required to prepare and implement a SWPPP to stay compliant with NCDEQ stormwater regulations.

Failing to have a compliant stormwater pollution plan in North Carolina can lead to significant consequences, including:

  • Civil penalties of up to $5,000 per day, per violation, assessed from the date of the violation and continuing for each day the violation persists. In some cases, cumulative penalties can be substantially higher depending on the duration and severity of non-compliance.

  • Stop-work orders issued by NCDEQ or local authorities

  • Mandatory corrective actions with possible follow-up inspections

  • In serious or willful cases, criminal penalties, including fines and potential jail time. Under federal Clean Water Act authority, civil penalties for permit violations can exceed tens of thousands per day and criminal fines can range higher, depending on the nature of the violation.
