Is a SWPPP required in Pennsylvania?
Yes. In Pennsylvania, most construction projects that disturb soil must prepare and implement a Stormwater Pollution Prevention Plan (SWPPP) under the SPDES Construction General Permit, administered by the Pennsylvania Department of Environmental Protection (PA DEP).
A SWPPP is generally required if:
- Your project will disturb one acre or more of land, or
- Your project will disturb less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more
If either condition applies, you must obtain PA DEP permit coverage and have a compliant SWPPP in place before construction begins.
What Happens If You Don’t Comply?
Failing to maintain a compliant SWPPP in Pennsylvania can result in serious enforcement actions, including:
- Civil penalties under the Pennsylvania Clean Streams Law (35 P.S. § 691.1001 et seq.) of up to $10,000 per day, per violation, depending on the severity and duration of non-compliance
- Stop-work orders issued by PA DEP or local municipal authorities
- Mandatory corrective actions, additional reporting requirements, and follow-up inspections
- In serious or willful cases, criminal penalties, including fines up to $50,000 per offense and potential imprisonment
Because Pennsylvania’s SPDES Construction General Permit program operates under the Clean Water Act, violations may also trigger enforcement by the United States Environmental Protection Agency (EPA). Federal civil penalties for Clean Water Act violations are adjusted annually for inflation and can currently reach approximately $56,460 per day, per violation.

What are the SWPPP requirements in Pennsylvania?

A SWPPP is required for the duration of active construction. Once your project is complete, coverage under the SPDES Construction General Permit ends when a Notice of Termination (NOT) is submitted to the PA DEP.
