Is a SWPPP required in Tennessee?
Yes. Under Tennessee’s NPDES Construction General Permit (CGP), administered by the Tennessee Department of Environment & Conservation (TDEC), most construction sites must have a SWPPP if:
- The project disturbs one acre or more, or
- It disturbs less than one acre but is part of a larger common plan of development or sale that will ultimately disturb one acre or more.
If those conditions apply, you’re legally required to develop and follow a SWPPP in order to comply with TDEC’s Construction Stormwater Permit.
Failing to maintain a SWPPP or meet permit conditions can trigger serious enforcement actions:
- Civil penalties: Under Tennessee law, violations of permit terms or effluent limits can result in up to $10,000 per day for each day of noncompliance.
- Municipal penalties: Some local governments may assess up to $5,000 per day for stormwater violations under their ordinances.
- Stop‑work orders: TDEC or local authorities may issue stop-work orders if violations are found.
- Mandatory corrective actions: You may be required to implement fixes (e.g., better erosion controls, stabilization).
Criminal penalties: Willful or severe violations could potentially lead to criminal enforcement. Under Tennessee’s Water Pollution Control Act, knowingly falsifying permit data or causing pollution can carry felony-level charges.

Who regulates SWPPP in Tennessee?

How long will the SWPPP last?
